What is the FARE Act and what did it change?

The FARE Act is an American rental law that shifted who pays a landlord's broker fee in that market, and it has no Saskatchewan equivalent because commission structures here already work differently. In Saskatchewan, commission is negotiable and the Saskatchewan Real Estate Commission requires it to be agreed in writing before a listing goes ahead.

The law it changed addresses a rental-market problem, tenants being billed for a broker the landlord hired, that Saskatchewan's Residential Tenancies Act framework does not create in the same way, since a tenant here is not typically charged a landlord's own brokerage fee at all.

On the sale side, the closer Saskatchewan comparison is how seller closing costs work. Those typically run 4 to 6 percent in total, covering commission, legal fees and adjustments together, and the split between listing and buyer's agent commission is set by negotiation and disclosed in writing rather than fixed by regulation.
