What happens if the seller will not leave?

If a seller stays past the possession date without a signed rent-back agreement, the buyer's recourse in Saskatchewan runs through their lawyer and, if it is not resolved quickly, the Court of King's Bench, which can order possession and award damages for the delay.

In practice most holdovers get resolved within 7 to 14 days through the lawyers directly, because the seller is now occupying a home they no longer own and accruing daily costs, interest and potential legal fees on top of whatever profit they made at closing.

The buyer's own costs during a holdover, temporary housing, storage, moving delays, can add up quickly, which is why a buyer's lawyer will often push for a holdback of sale proceeds in trust until possession actually happens, rather than releasing full funds on the scheduled date.
