An executor needs a grant of probate from the Court of King's Bench before selling estate property in most cases, and the sale proceeds flow through the estate rather than directly to any one family member. A lawyer handling the estate can confirm what stage the probate process needs to reach before listing.
If a family member is still living but unable to manage their own affairs, a power of attorney document authorizes the sale, and the lawyer closing the transaction will want to see it before proceeding. The Homesteads Act, 1989 can also apply if a spouse is involved, since it protects the family home regardless of whose name is on title.
