Do we both have to agree to sell the house?

Yes, whether the reason is divorce, an inheritance shared between siblings or two names on one title, Saskatchewan law generally requires every registered owner's agreement before a home can be listed and sold, and a spouse's consent is protected separately under The Homesteads Act, 1989 even when only one name is on title.

Where the disagreement is between spouses, The Family Property Act sets out how a court divides the proceeds if the parties cannot settle it themselves, and a refusal to sell can be tested through the Court of King's Bench rather than left unresolved indefinitely.

Where the disagreement is between co-owners who are not spouses, such as siblings who inherited a property, the same principle applies: one owner cannot force title to transfer without the others' signatures on the listing and the purchase agreement.
