Do I need to pay the mortgage on an inherited property during probate?

Yes. A mortgage does not pause just because the borrower has died, so the estate, through its executor, keeps making payments during probate at the Court of King's Bench for Saskatchewan, and missing them can put the home into default even while Letters Probate are still pending.

The executor is responsible for keeping the property insured and the mortgage current using estate funds, and title stays with the deceased until it is formally transmitted to the executor at Information Services Corporation, a step that has to happen before the home can be sold or transferred to an heir.

Saskatchewan probate fees are charged per $1,000 of estate value, which keeps the process comparatively inexpensive next to Ontario or British Columbia, but the timeline still runs weeks to months, and a lender does not extend that timeline just because probate is underway.

If the mortgage payment is a strain on the estate, selling sooner rather than waiting out probate is often the more affordable path. Get your hand-reviewed valuation from Joel Dyck.
