This is a title requirement, not just a family law one. Even a married couple with no dispute at all still needs both names on all closing documents, the same as any two people who jointly own a property together, and a missing signature can add 1 to 2 weeks while it gets corrected.
If only one spouse holds title but the home still qualifies as family property, the non-titled spouse's consent may still be required under The Family Property Act even though their signature does not appear on the transfer itself.
