Can one spouse sell the house without the other in Saskatoon?

Generally no, if the home qualifies as the family home. The Homesteads Act, 1989 requires a spouse's consent before the family home can be sold or mortgaged in Saskatchewan, regardless of which one of the two spouses' names sits on the title itself.

That protection exists specifically to prevent one spouse from disposing of the family residence without the other's knowledge, and a lawyer handling the transaction through Information Services Corporation will confirm that consent is in place before closing.

If the couple is separating, The Family Property Act governs how the home is divided, and a court order can sometimes substitute for consent when one spouse is unreachable or unreasonably withholding it.
